Please read these Terms and Conditions ("Terms") carefully before using the Football Apptitude mobile application (the "App"), operated by FOOTBALL APPTITUDE LTD, a company registered in England and Wales (company number 17185338, registered office 27 Old Gloucester Street, London, United Kingdom, WC1N 3AX) ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.
1: Definitions
"App" means the Football Apptitude mobile application on Android and iOS.
"Content" means all football statistics, analytics, scores, simulation outputs, and other data provided through the App.
"Subscription" means the recurring monthly payment for premium, ad-free access to the App; the current price is shown to you at the point of purchase.
"Free, Ad-Supported Access" means access to the App at no charge, supported by advertising, offered as an alternative to a paid Subscription.
"Access Code" means the unique code issued to you, whether on taking out a Subscription or on obtaining Free, Ad-Supported Access, used to authenticate your access to the App.
"Simulator" means the App's Match Simulator feature, which produces simulation outputs from statistical parameters supplied by our servers and computed on your device.
2: Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the App. By using the App, you confirm that you meet this requirement.
3: Account and Access
How you receive your Access Code depends on how you obtain access. If you subscribe through our website, your Access Code is sent to you by email. Please check your Junk / Spam folders for the email if it does not appear promptly.
If you subscribe through Apple In-App Purchase or Google Play Billing, or if you use Free, Ad-Supported Access, your Access Code is issued to you directly within the App. Your Access Code is personal to you and must not be shared, transferred, sold, or distributed to any other person.
You are responsible for keeping your Access Code secure. We are not liable for any unauthorised use of your account resulting from your failure to protect your Access Code.
We reserve the right to suspend or terminate your access at any time if we reasonably believe your Access Code is being shared or misused.
4: Subscription and Payment
The App is available on two bases: Free, Ad-Supported Access at no charge, and a paid Subscription that removes advertising and unlocks premium features. You may use the App under either basis. This Section applies to paid Subscriptions.
A paid Subscription is a recurring monthly payment that renews automatically until cancelled. The current price is shown to you at the point of purchase and may vary depending on the platform through which you subscribe. The payment provider, and the terms of renewal, cancellation, and refund, also depend on where you take out your Subscription.
Apple In-App Purchase (iOS): On iOS, payment is processed by Apple via In-App Purchase. By subscribing through the App Store, you also agree to Apple's Media Services Terms and Conditions (https://www.apple.com/legal/internet-services/itunes/). Your Subscription renews automatically each month unless cancelled at least 24 hours before the end of the current period. To cancel, go to Apple Account Settings > Subscriptions. Apple's standard refund policy applies to all App Store purchases, and refund requests must be directed to Apple.
Google Play Billing (Android): On Android, payment is processed by Google via Google Play Billing. By subscribing through Google Play, you also agree to Google Play's Terms of Service (https://play.google.com/about/play-terms/). Your Subscription renews automatically each month unless cancelled. To cancel, open the Google Play Store and select Subscriptions. Google's standard refund policy applies to Google Play purchases, and refund requests must be directed to Google.
Stripe (website): If you subscribe through our website, payment is processed by Stripe. By subscribing, you also agree to Stripe's terms of service (https://stripe.com/legal). Your Subscription renews automatically each month unless cancelled. You may cancel at any time through the Stripe customer portal, or by contacting us at cancel@footballapptitude.com at least 48 hours before the next billing date. Cancellation takes effect at the end of the current billing period.
All fees are quoted in GBP. Fees paid through Stripe are non-refundable except where required by applicable law, and we do not offer partial refunds for unused portions of a billing period under the Stripe payment path. Refunds for App Store and Google Play purchases are handled by Apple and Google respectively, in accordance with their policies.
We reserve the right to change the Subscription price at any time. Any price change will take effect from the next billing cycle, and we will notify you in advance.
5: Licence and Use
Subject to these Terms, and for the duration of your active Subscription or Free, Ad-Supported Access, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on your personal device(s) for your own personal, non-commercial use.
You must not:
Copy, modify, reverse-engineer, decompile, or disassemble the App or any part of it.
Use the App for any commercial purpose, including reselling or redistributing Content.
Use automated tools, bots, or scripts to access or interact with the App.
Attempt to gain unauthorised access to our systems, servers, or databases.
Use the App in any way that violates applicable law or regulation.
6: Intellectual Property
The App itself, including its design, code, graphics, logos, and trademarks, together with the analytics, and simulation outputs generated by our models, is owned by or licenced to FOOTBALL APPTITUDE LTD and is protected by intellectual property laws.
The underlying football statistics and match data displayed in the App are provided by third-party data providers and are used under licence. Those providers, or their own licensors, retain all rights in that data. Nothing in these Terms grants you any right, title, or interest in our intellectual property, or in that third-party data, beyond the limited licence in Section 5.
7: Statistical Data and Model Accuracy
THIS SECTION IS PARTICULARLY IMPORTANT. PLEASE READ IT CAREFULLY.
INFORMATIONAL PURPOSES ONLY: All football statistics, analytics, comparisons, form data, and simulation outputs provided by the App (collectively, the "Outputs") are for general informational and entertainment purposes only. They do not constitute advice of any kind, including but not limited to financial advice, betting advice, investment advice, or professional guidance.
THE SIMULATOR AND OTHER ANALYTICAL FEATURES: The App's analytical features include statistical comparisons, which are produced by normalising player and team metrics against the relevant population, and the Match Simulator (the "Simulator"). All of these features produce Outputs that are for information only, as stated above. The Simulator in particular does not predict, forecast, or tell you the outcome of any football match. What it does, and why its outputs are not predictions, is explained in the two paragraphs that follow:
WHAT THE SIMULATOR DOES: The Simulator applies a statistical model of a match, being a set of estimated per-player and per-team scoring rates derived from historical data, and repeatedly samples from the probability distributions implied by that model in order to generate a large number of hypothetical, simulated match outcomes. The figures it reports, such as the proportion of simulated matches in which a particular result, scoreline, or event occurred, are frequencies produced by the model under its own assumptions. They are properties of the model. They are not statements about what will happen in the real fixture.
SIMULATIONS ARE NOT PREDICTIONS: A simulated frequency is not the probability of a real-world event, and a simulation is not a prediction. A real match is a single, one-off event that either occurs or does not, and a distribution of simulated outcomes cannot be verified against that single realisation. The simulated figures depend entirely on the input estimates and modelling assumptions, which are simplifications of reality and carry their own uncertainty; and because the Simulator deliberately introduces random sampling, running the same fixture again will generally produce different figures. Each simulation is therefore an illustration of how the model behaves under a given set of assumptions, being a range of hypothetical scenarios, and must not be read as a forecast, a prediction, an expected result, or an indication of the likely or actual outcome of any real match.
NO GUARANTEE OF ACCURACY: The Outputs are generated by statistical models based on historical data. We make no warranty, representation, or guarantee, express or implied, that any Output is accurate, complete, reliable, current, or error-free. Statistical models are inherently uncertain, and past performance is not indicative of future results.
DATA QUALITY: The underlying football data used by the App is sourced from third parties. While we endeavour to use reliable sources, we do not independently verify every data point and cannot guarantee the accuracy, completeness, or timeliness of the source data. Errors, omissions, or delays in the underlying data may affect the Outputs.
MODEL LIMITATIONS: Our statistical models are based on historical patterns and do not account for all variables that may influence the outcome of a football match, including but not limited to: injuries, suspensions, weather conditions, managerial changes, player fitness, morale, tactical changes, or other unforeseen events. You acknowledge that no statistical model, and no simulation, can determine the outcome of a sporting event.
YOUR RESPONSIBILITY: Any decision you make on the basis of the Outputs, including but not limited to, any decision to place a bet, wager, or other financial commitment, is made entirely at your own risk and discretion. You are solely responsible for evaluating the suitability and reliability of any Output before acting on it. If you choose to interpret, use, or rely upon any simulation output as though it were a prediction of a real match, you do so entirely of your own volition and at your own risk, and we accept no responsibility or liability whatsoever for that use.
NO LIABILITY FOR LOSSES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY FINANCIAL LOSS, BETTING LOSS, OR OTHER LOSS OR DAMAGE (WHETHER DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY) ARISING FROM OR IN CONNECTION WITH:
Your reliance on any Output, statistic, analytic, or simulation result provided by the App.
Your treatment of, or reliance upon, any simulation output as a prediction, forecast, or expected outcome.
Any inaccuracy, error, or omission in the data or the Outputs.
Any decision you make, or action you take, based on information provided by the App.
Any bet, wager, or financial transaction placed by you on the basis of the Outputs.
8: Not a Gambling Service
The App is a statistical analysis and simulation tool only. It does not facilitate, arrange, process, or handle any bets, wagers, or gambling transactions. The App does not accept, hold, or pay out money in connection with any bet. Any betting activity you engage in is conducted through third-party services that are entirely independent of FOOTBALL APPTITUDE LTD
You are responsible for ensuring that any betting or gambling activity you undertake complies with the laws of your jurisdiction. We accept no responsibility for any gambling-related losses or for the legality of gambling in your location.
9: Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN SUBSCRIPTION FEES IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR: (i) DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE; (ii) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (iii) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW.
10: Indemnification
You agree to indemnify and hold harmless FOOTBALL APPTITUDE LTD, its officers, directors, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your breach of these Terms, or your violation of any applicable law.
11: Third-Party Services
The App relies on a number of third-party services, including: Apple (the App Store and In-App Purchase); Google Play (Google Play Billing); Google AdMob (advertising in the free, ad-supported version); Google Cloud (Cloud Run and Firestore); Google Firebase (Cloud Messaging); the Google Play Integrity API and Apple DeviceCheck (device verification for free, ad-supported access); Stripe (website payments); and Resend (transactional email). Each such service is governed by its own terms and privacy policy.
We are not responsible for the availability, accuracy, or reliability of these services. Any outage, error, or limitation of a third-party service may affect the App's functionality, and we accept no liability for such events.
12: Availability and Modifications
We do not guarantee that the App will be available at all times or free from interruption. We may perform maintenance, updates, or modifications without prior notice.
We reserve the right to modify, update, or discontinue any feature of the App at any time, including the statistical models, data sources, and analytical features available.
We reserve the right to discontinue the App entirely. In such event, active Subscriptions will not be renewed and no further charges will be made.
13: Suspension and Termination
We may suspend or terminate your access immediately if you breach these Terms, share your Access Code, or use the App in a way we consider harmful or inappropriate.
Upon termination, your licence to use the App ceases immediately. Any locally stored data on your device will remain until you uninstall the App or clear its data.
Sections 7 (Statistical Data, Simulations, and Model Accuracy), 8 (Not a Gambling Service), 9 (Limitation of Liability), and 10 (Indemnification) shall survive termination.
14: Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15: Changes to These Terms
We may update these Terms from time to time. Any changes will be reflected on this page with an updated effective date. Continued use of the App after changes constitutes acceptance of the revised Terms. If we make material changes, we will make reasonable efforts to notify you, for example by an in-app notice.
16: Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
17: Entire Agreement
These Terms, together with our Privacy Policy (available at footballapptitude.com/policy), constitute the entire agreement between you and FOOTBALL APPTITUDE LTD regarding your use of the App.
