Please read these Terms and Conditions ("Terms") carefully before using the Football Apptitude mobile application (the "App") operated by Football Apptitude ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Definitions
"App" means the Football Apptitude mobile application on Android and iOS.
"Content" means all football statistics, predictions, analytics, scores, and other data provided through the App.
"Subscription" means the recurring monthly payment (currently £5/month) required to access the App.
"Access Code" means the unique code issued to you upon subscribing, used to authenticate your access to the App.
2. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the App. By using the App, you confirm that you meet this requirement.
3. Account and Access
Upon subscribing, you will receive an Access Code by email. This code is personal to you and must not be shared, transferred, sold, or distributed to any other person.
You are responsible for keeping your Access Code secure. We are not liable for any unauthorised use of your account resulting from your failure to protect your Access Code.
We reserve the right to suspend or terminate your access at any time if we reasonably believe your Access Code is being shared or misused.
4. Subscription and Payment
Access to the App requires an active paid Subscription. Payment is processed by Stripe. By subscribing, you also agree to Stripe's terms of service (https://stripe.com/legal).
Subscriptions renew automatically each month unless cancelled. You may cancel at any time via the Stripe customer portal or by contacting us at admin@footballapptitude.com. Cancellation takes effect at the end of the current billing period.
All fees are quoted in GBP and are non-refundable except where required by applicable law. We do not offer partial refunds for unused portions of a billing period.
We reserve the right to change the Subscription price at any time. Any price change will take effect from the next billing cycle and we will notify you in advance.
5. Licence and Use
Subject to these Terms and for the duration of your active Subscription, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on your personal device(s) for your own personal, non-commercial use.
You must not:
Copy, modify, reverse-engineer, decompile, or disassemble the App or any part of it.
Use the App for any commercial purpose, including reselling or redistributing Content.
Use automated tools, bots, or scripts to access or interact with the App.
Attempt to gain unauthorised access to our systems, servers, or databases.
Use the App in any way that violates applicable law or regulation.
6. Intellectual Property
All Content, design, code, graphics, logos, and trademarks within the App are owned by or licenced to Football Apptitude and are protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property beyond the limited licence in Section 5.
7. Statistical Data, Predictions, and Model Accuracy
THIS SECTION IS PARTICULARLY IMPORTANT. PLEASE READ IT CAREFULLY.
INFORMATIONAL PURPOSES ONLY. All football statistics, predictions, expected values, probabilities, and analytical outputs provided by the App (collectively, "Predictions") are for general informational and entertainment purposes only. They do not constitute advice of any kind, including but not limited to financial advice, betting advice, investment advice, or professional guidance.
NO GUARANTEE OF ACCURACY. Predictions are generated by statistical models based on historical data. We make no warranty, representation, or guarantee — express or implied — that any Prediction is accurate, complete, reliable, current, or error-free. Statistical models are inherently uncertain and past performance is not indicative of future results.
DATA QUALITY. The underlying football data used by the App is sourced from third parties. While we endeavour to use reliable sources, we do not independently verify every data point and cannot guarantee the accuracy, completeness, or timeliness of the source data. Errors, omissions, or delays in the underlying data may affect Predictions.
MODEL LIMITATIONS. Our prediction models are based on historical statistical patterns and do not account for all variables that may influence the outcome of a football match, including but not limited to: injuries, suspensions, weather conditions, managerial changes, player fitness, morale, tactical changes, or other unforeseen events. You acknowledge that no statistical model can predict the outcome of a sporting event with certainty.
YOUR RESPONSIBILITY. Any decision you make based on Predictions — including any decision to place a bet, wager, or other financial commitment — is made entirely at your own risk and discretion. You are solely responsible for evaluating the suitability and reliability of any Prediction before acting on it.
NO LIABILITY FOR LOSSES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY FINANCIAL LOSS, BETTING LOSS, OR OTHER LOSS OR DAMAGE (WHETHER DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY) ARISING FROM OR IN CONNECTION WITH:
Your reliance on any Prediction, statistic, or analytical output provided by the App.
Any inaccuracy, error, or omission in the data or Predictions.
Any decision you make, or action you take, based on information provided by the App.
Any bet, wager, or financial transaction placed by you on the basis of Predictions.
CUSTOM PREDICTIONS. The same limitations and disclaimers apply equally to Custom Lineup Predictions that you generate by selecting your own starting lineups. Custom Predictions are processed using the same statistical models and are subject to the same inherent uncertainties and limitations.
8. Not a Gambling Service
The App is a statistical analysis and prediction tool only. It does not facilitate, arrange, process, or handle any bets, wagers, or gambling transactions. The App does not accept, hold, or pay out money in connection with any bet. Any betting activity you engage in is conducted through third-party services that are entirely independent of Football Apptitude.
You are responsible for ensuring that any betting or gambling activity you undertake complies with the laws of your jurisdiction. We accept no responsibility for any gambling-related losses or for the legality of gambling in your location.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN SUBSCRIPTION FEES IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR: (i) DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE; (ii) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (iii) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW.
10. Indemnification
You agree to indemnify and hold harmless Football Apptitude, its officers, directors, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your breach of these Terms, or your violation of any applicable law.
11. Third-Party Services
The App relies on third-party services including Google Cloud, Firebase, Stripe, and Resend. We are not responsible for the availability, accuracy, or reliability of these services. Any outage, error, or limitation of a third-party service may affect the App's functionality, and we accept no liability for such events.
12. Availability and Modifications
We do not guarantee that the App will be available at all times or free from interruption. We may perform maintenance, updates, or modifications without prior notice.
We reserve the right to modify, update, or discontinue any feature of the App at any time, including the statistical models, data sources, and types of Predictions available.
We reserve the right to discontinue the App entirely. In such event, active Subscriptions will not be renewed and no further charges will be made.
13. Suspension and Termination
We may suspend or terminate your access immediately if you breach these Terms, share your Access Code, or use the App in a way we consider harmful or inappropriate.
Upon termination, your licence to use the App ceases immediately. Any locally stored data on your device will remain until you uninstall the App or clear its data.
Sections 7 (Statistical Data, Predictions, and Model Accuracy), 8 (Not a Gambling Service), 9 (Limitation of Liability), and 10 (Indemnification) shall survive termination.
14. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Changes to These Terms
We may update these Terms from time to time. Any changes will be reflected on this page with an updated effective date. Continued use of the App after changes constitutes acceptance of the revised Terms. If we make material changes, we will make reasonable efforts to notify you (e.g. via email or an in-app notice).
16. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy (available at footballapptitude.com/privacy), constitute the entire agreement between you and Football Apptitude regarding your use of the App.
